These Website Terms of Use (“Terms”) govern your use of arborinfusion.com and other public-facing webpages, forms, and digital resources that link to these Terms collectively, the “Website”. The Website is owned or operated by Arbor Infusion. By accessing or using the Website, you agree to these Terms. Do not use the Website if you do not agree.

Additional terms may apply to patient portals, payments, recruiting, text messages, electronic signatures, or other services. Those additional terms control if they conflict with these Terms for the applicable service.

  1. Eligibility and Authority

You may use the Website only if you are legally able to agree to these Terms. If you are under the age of 13, a parent or legal guardian should act on your behalf. If you use the Website for another person or organization, you represent that you are authorized to do so.

  1. Informational Purpose; No Medical Advice

The Website provides general information about Arbor Infusion, outpatient infusion and injection services, locations, medications, conditions, referrals, employment, and related topics. Website content is not individualized medical advice, diagnosis, treatment, prescribing information, insurance advice, or emergency care. It may not include every indication, warning, contraindication, risk, benefit, interaction, or alternative.

Do not disregard or delay professional medical advice because of Website content. Direct medical questions to an appropriately licensed healthcare provider.

  1. No Emergency Services

The Website is not an emergency communication service, and Arbor Infusion is not an emergency healthcare provider.nDo not use Website forms, email, chat, or voicemail to report urgent symptoms, severe medication reactions, or other emergencies. Call 911 or seek appropriate emergency care if an emergency may exist. Website submissions may not be monitored continuously and are not guaranteed an immediate response.

  1. No Provider-Patient Relationship

Accessing the Website, reviewing content, submitting an inquiry, or completing a form does not by itself establish a provider-patient relationship or create a duty to provide care. A provider-patient relationship may be established only through Arbor Infusion’s applicable referral, intake, clinical-review, consent, and acceptance processes.

  1. Referrals, Scheduling, and Service Availability

A referral or inquiry is a request for review. It does not confirm that:

  • Required records or orders are complete;
  • Arbor Infusion can safely or legally provide the requested service;
  • The patient meets clinical or operational acceptance criteria;
  • Insurance coverage, prior authorization, or financial clearance is available;
  • Medication can be obtained;
  • An appointment has been scheduled; or
  • A medication or service is available at a particular location.

Arbor Infusion may request additional records, orders, laboratory results, insurance information, or clinical clarification. Arbor Infusion may accept, decline, postpone, or reschedule services for clinical, legal, safety, insurance, supply, staffing, or operational reasons.

  1. Insurance, Authorization, and Cost Information

Website information about benefits, coverage, prior authorization, financial assistance, estimated charges, or patient responsibility is general and is not a guarantee. Coverage and payment may depend on plan terms, network status, medical necessity, site-of-care requirements, authorization, deductibles, coinsurance, drug-acquisition requirements, third-party program rules, and information supplied by others. Benefits verification or authorization does not guarantee claim payment. Patients remain responsible for amounts assigned to them under applicable agreements, benefit plans, and law.

  1. Medication and Service Information

Website references to medications, conditions, specialties, or services do not mean that:

  • Every medication or service is offered;
  • Every location offers the same services;
  • A therapy is appropriate for a particular patient;
  • Arbor Infusion will accept a referral;
  • A medication is available;
  • A payer will authorize treatment; or
  • Website information replaces current prescribing information.

Clinical guidance, labeling, payer policies, service availability, and medication supply may change. Confirm material information with an appropriate healthcare provider, payer, manufacturer, or Arbor Infusion representative. Arbor Infusion does not manufacture medications and is not responsible for manufacturer-controlled labeling, recalls, shortages, or supply interruptions.

  1. Website Forms and User Information

You agree to provide information that is accurate and complete to the best of your knowledge. You may not impersonate another person, misrepresent your authority, submit fraudulent or altered records, disclose information without authorization, or use a form for an unlawful or unrelated purpose. Submitting information does not require Arbor Infusion to accept a patient, provide services, schedule an appointment, enter a business relationship, offer employment, or respond within a particular time. If you submit information about another person, you represent that you have an appropriate basis and authority to do so.

  1. Electronic Communications

By providing contact information or submitting a form, you authorize Arbor Infusion to contact you to respond to or administer your request, subject to applicable law. Standard email and ordinary text messages may not be secure. Do not send detailed medical or other highly sensitive information through a general email address or unsecured channel unless instructed to do so. Consent to receive a response is not necessarily consent to unrelated marketing. Separate terms or consents may apply to reminders, automated calls or texts, recruiting, electronic signatures, patient portals, and other programs.

  1. Privacy

Arbor Infusion’s Website Privacy Policy explains how information is processed through the Website. The Website Privacy Policy is separate from Arbor Infusion’s Notice of Privacy Practices (“NPP”). When Arbor Infusion receives or maintains protected health information as a healthcare provider, the NPP and applicable healthcare privacy laws may apply.

  1. Limited License and Intellectual Property

Subject to these Terms, Arbor Infusion grants you a limited, revocable, nonexclusive, nontransferable license to use the Website for lawful personal, patient-care coordination, professional, or business purposes. The Website and its text, graphics, design, logos, photographs, videos, software, downloads, and other content are owned by Arbor Infusion or used under license and are protected by law. Arbor Infusion names, logos, slogans, and designs are trademarks or service marks of Arbor Infusion or their owners.

You may print or download a reasonable number of pages for personal, noncommercial, patient-care coordination, or internal professional use if you preserve ownership notices and do not alter the content.

Without written permission, you may not:

  • Copy or redistribute substantial Website content;
  • Commercialize or create derivative works from Website content;
  • Use content to train or develop an artificial-intelligence or machine-learning system;
  • Remove ownership notices;
  • Suggest Arbor Infusion endorsement;
  • Use Arbor Infusion content or marks misleadingly; or
  • Use the Website contrary to these Terms.
  1. Prohibited Conduct

You may not:

  • Use the Website unlawfully, fraudulently, deceptively, or harmfully;
  • Gain or attempt unauthorized access to systems, accounts, databases, or networks;
  • Test or bypass security controls without authorization;
  • Introduce malicious code;
  • Disrupt the Website or another person’s use;

  • Submit unsolicited promotions;
  • Harass, threaten, impersonate, or violate another person’s rights;
  • Misrepresent an affiliation with Arbor Infusion; or
  • Assist another person in prohibited conduct.

Ordinary search-engine indexing conducted in accordance with standard technical instructions is permitted.

  1. Feedback

You may provide suggestions or feedback. Unless otherwise agreed in writing, Arbor Infusion may use nonconfidential feedback without compensation to improve its services. This provision does not authorize use of PHI, medical information, applicant information, referral information, or other personal information contrary to law or Arbor Infusion’s privacy notices. Do not submit trade secrets or confidential business information as general feedback.

  1. Third-Party Services

The Website may link to or integrate with third-party maps, social media, recruiting, payment, scheduling, communication, healthcare-information, manufacturer, insurer, or other services. Independent third parties control their own content, availability, security, terms, and privacy practices. A link does not necessarily constitute endorsement. Your use of an independent third party is governed by that party’s terms, except where it acts on Arbor Infusion’s behalf.

  1. Accuracy, Availability, and Security

Arbor Infusion seeks to provide useful information but does not guarantee that Website content is complete, current, or error-free. Information may change because of clinical guidance, medication labeling, payer rules, laws, staffing, hours, locations, or available services. Arbor Infusion may update, suspend, restrict, or discontinue any content or feature without notice. It does not guarantee continuous availability, compatibility with every device, successful transmission of every form, or freedom from errors or harmful components.

Do not rely on the Website as the sole method for a time-sensitive referral, order, notice, or communication unless Arbor Infusion confirms receipt. You are responsible for reasonable device security and for retaining copies of important submissions.

  1. Limitation of Liability

To the fullest extent permitted by law, Arbor Infusion and its directors, officers, workforce members, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the Website. This includes, where legally permitted, losses arising from inability to access the Website, reliance on general content, delayed or unsuccessful form transmission, third-party services, unauthorized access outside Arbor Infusion’s reasonable control, lost data, lost profits, or interruption. These Terms do not limit rights concerning clinical services actually provided or rights under applicable healthcare, privacy, or consumer-protection law.

  1. Suspension or Termination

Arbor Infusion may restrict or terminate access when it reasonably believes a person violated these Terms, created a security risk, acted unlawfully, disrupted the Website, or threatened the rights or safety of another. Provisions that should survive termination, including ownership, disclaimers, liability limitations, and general legal provisions, will remain effective.

  1. Governing Law and Venue

These Terms are governed by the laws of Tennessee, without regard to conflict-of-law principles, except where another law must apply. Subject to rights that cannot be waived, a legal action arising solely from Website use must be brought in a state or federal court located in Davidson County, TN.

  1. Changes

Arbor Infusion may modify the Website or these Terms. Updated Terms will be posted with a revised date and will apply prospectively when posted or on a stated later date. When required by law, Arbor Infusion will provide additional notice or obtain consent. Continued Website use after updated Terms become effective constitutes acceptance.

  1. General Terms

If a provision is invalid or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. A waiver must be in writing and signed by an authorized Arbor Infusion representative. You may not assign these Terms without Arbor Infusion’s written permission. Arbor Infusion may assign them in connection with a merger, reorganization, financing, sale, change in control, or transfer of the Website or applicable operations.

These Terms are the entire agreement concerning general Website use. They do not replace patient consents, clinical or financial policies, employment or vendor agreements, portal terms, payment terms, text-message terms, the Website Privacy Policy, or the NPP, each of which governs its subject matter.
